Is it legal for a collection agency to report to a bureau an unpaid bill without contacting the consumer first?

I have a collection showing up on my credit report that was just posted for services I may or may not have received two years ago by a hospital. Problem is I never received a bill from the hospital, but I recently applied for a Parent Plus loan for my son’s college tuition and was denied because a collection agency provided this information to the Experian. I never received anything from the hospital or the collection agency. If I had received a bill I certainly would have contacted the hospital or the agency to validate it. But nothing, never received a bill. How can I get this off my credit report?

i know i didn’t get approved but why? i can’t understand the letter, it doesn’t really tell me anything. i have good credit as i only used it once and every payment was on time. i can purchase things online with my debit card so my information is correct. i don’t see what the problem is. do i have to use different information as my debit card information. my drivers license information? where is the information they’re trying to verify?

The importance of a credit report cannot be ignored. An accurate report can help you obtain loans for major purchases, or even help you rent an apartment. All this, and more, becomes difficult if you have negative errors in your report.

A negative report can prove to be an obstacle if you are job hunting. This is because most employers will go through your credit history before offering employment. You might want to note that each bureau offers credit ID fraud called safeguard services, but for fees. For example TransUnion offers “ID Fraud Watch”. For $10.95 each quarter, you get a credit report every three months and $25,000 of identity theft insurance.

Once you have your report, what do you look for?

Here are some basic things you should check on your report. Go through your entire report entry by entry. Have the credit agency legend by your side in order to verify coding compliance. Have also a paper and pencil to annotate any item you find in error. Go slowly.

Don’t assume your personal information is correct. You could be viewing information from someone else’s report with just a simple error such as: first name misspelled, missing Jr./Sr., erroneous address, bad zip code, wrong employer, or any other incorrect personal data.

Insure marital information is correct. Are accounts listed as “joint” really joint?

Is the report in compliance with court settlements? Outdated information is normally considered to be any item older than 7 years except for bankruptcy, which is usually 10 years.

Closed accounts should not be listed as open. Accounts you closed should reflect, “Closed by consumer”. Otherwise it can be assumed that it was closed by the creditor– not good.

Accounts should not appear twice even in different sections.

Incorrect histories such as late payments, a credit entry you do not recognize, a pre-marital debt of your current spouse, or other such items need your attention.

Are there missing reports that would be beneficial to show a good history, and are profiles, credit limits, and balances correct?

A former correction to your credit file that has since disappeared should be brought to the agency’s attention.

Reporting depends on who owns the account there are several directions this can take:

If the original creditor still owns the account but assigns the debt to a collection company then both get to report on that account listing.

If the original creditor retracts the collection and re-assigns it to a new collection agency then both original creditor and the 2nd collection agency can report but the first one must remove their listing off of the credit report.

If the original creditor sells the debt to a collection agency then the creditor will report zero balance / sold to another lender, and the collection agency will report.

If that collection agency assigns a debt to another collection agency then it is allowable for both to report the account listing, but if they take back that account then that assigned collection agency must remove their reporting.

Now if that collection agency sells the debt to another collection agency they get to keep their reporting on the report since they owned the account at one time, and the new collection agency picks up on the reporting.

Therefore, the difference is if your account is “assigned” or “sold”.

Is Credit Monitoring or Identity Monitoring Right For Me?

Credit report monitoring is defined as the constant watch over your credit report and history in order to detect any suspicious activity or change in your credit file. It detects identity theft and other credit related fraud. Credit monitoring services are a great option if you want to keep a close eye on your credit report. Having been a victim of both identity fraud and credit card theft, I use another option called identity monitoring. I wish I had this service before the crimes. According to the U.S. Federal Trade Commission, it takes an average of 12 months for a victim of identity theft to notice. It took me eight. An identity monitoring service will alert you of inquiries for credit as well as changes in your credit report to aid you in stopping the theft before actual damage occurs.

You can monitor your own credit, making sure your record represents you fairly and accurately, by regularly ordering and reviewing your consumer credit reports from the three major reporting agencies. You can request a report from each of the three reporting bureaus (Equifax, Experian, and Transunion) at the same time or at different times. The advantage of reviewing the three reports at once is that you can get a complete picture of your consumer credit report history. The disadvantage is that it is a one-shot deal and you do not have the advantage of an ongoing review. There is a better way to monitor your credit yourself.

Under a new Federal law, you have the right to receive a free copy of your credit report once every 12 months from each of the three nationwide consumer reporting companies. (To request your free report under that law, go to http://www.annualcreditreport.com.) This is a great option if you want to monitor the accuracy of your consumer credit reports throughout the year for free. Just request your report from one bureau initially, then follow up with another bureau’s report four months later, and the third four months after that. Each time, if you find errors, no matter how small, be sure you get them fixed right away. Even if you find the suspicious activity on just one report, make sure that you contact all three credit bureaus to ensure they make any necessary changes. You should receive amended reports within a week after the changes take effect.

A third option is to use an identity monitoring service. This service monitors the information related to your identity, and notifies you right away of any suspicious or seemingly fraudulent activity. It allows you to correct any errors associated with your identity without having to suffer the consequences of finding out months after the theft has occurred. Though you may not be able to prevent a theft from occurring, a timely notification system can help you can avoid any losses by helping you get quick resolution. The average identity theft costs the victim over $5,000 and takes over 400 hours to resolve if it is not detected quickly.

Whether you decide to use a credit monitoring service, self-monitor your credit report, or use an identity monitoring service, a pro-active stance is the best defense against identity theft.
