Is it a violation of HIPPA for med bills (hospital bill $48,000) to be on credit reports?

Credit Reports
luvtahug asked:

I’m job hunting and they pull reports before they hire you. I’m in my 50′s and very healthy, but they may use this to assume I have medical problems that I no longer have. Anyone know how to get the medical stuff removed from credit reports? This should be a violation of HIPAA because it should be a private matter when it can affect my job applications or applying for medical insurance. Help???

  1. Sorry, but these are public records and are not covered by HIPPA.

The only reason they are on your credit report is because you did not take care of them at the time.

As far as removing them, only time will do that per the Fair Credit Reporting Act derogatory accounts show for 7-years from the date of first delinquency which works out to 7-years and 180-days.

Any accounts that show for longer then that can be disputed and removed.

  2. Mexico and 3rd world countries usually offer record expunges after 7-15 years.

    Or sue for discrimination.

It is not a violation because it does not have any details about what you were treated for.

  4. This is not a HIPAA violation, this only shows credit worthiness. Employers use this to determine if you are a reliable EE. A HIPAA violation would be actually divulging PHI and it doesn’t. The medical bill can be some one else’s bill that you’re responsible for. It is a lot but unti they are paid they will be there. I would check to see what date they are scheduled to remain there till.

No, it is not a HIPPA violation. It only displays the amount owed on a credit report, not what your services were (which WOULD be a violation).

Your medical records are private, not your debt records.
