How do I file an “offer in compromise” with the IRS and actually have them accept?

Laustinlove asked:

I owe the IRS like 8k and have recently found out that someone has been using my SS# to report taxes. I already reported this case to the Federal Consumer Services and have alerted the Credit Bereaus, oh and I filed a police report……What do I do next? I dont think I am responsible for the entire amount. Any advice?

If the entire $8k is from the identity theft, you shouldn’t have to pay any of it. Contact the Taxpayer Advocate in your area.

The chance of getting the IRS to accept an OIC on only $8k in debt is .000. They general don’t accept any for amounts this “small”.

Well, the first thing that needs to happen is the IRS needs to figure out who those taxes belong to. If they arent yours, you arent responsible for them. If you do owe the IRS a large amount and they are your taxes, you can call the IRS and ask to speak with someone about it. The general number is 1-800-829-1040, but I dont think you will need to pay those taxes if the income isnt yours.

You can go on the IRS website irs.gov and read about an OIC and there is a lot of financial information you will have to fill out if you do need an offer in compromise. Also with one, you have to file and pay your taxes on time for 5 years or it reverts back to what you originally owe.

From what you said, you dont need an OIC, the taxes need to be attributed to the person responsible for them.
